• Ni8.Life enables users to engage in AI-driven, voice-based phone conversations with virtual characters powered by artificial intelligence, text-to-speech, and telephony systems.
• The platform integrates technologies such as OpenAI, ElevenLabs, and Twilio, as well as payment processing via Stripe.
• The Services are for entertainment and companionship purposes only.
• They are not intended for therapy, counseling, or emergency communication.

2. Eligibility

To use Ni8.Life, you must:

• Be at least 18 years old (or the age of majority in your jurisdiction).
• Have the legal capacity to enter into a binding agreement.
• Provide accurate information during registration or payment.
• Not be barred from using such services under applicable laws.

If you use the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Use of the Service

3.1 Acceptable Use

You agree to use the Platform only for lawful, personal, and non-commercial purposes. You shall not:

• Use the Services for any unlawful, obscene, defamatory, or harassing purposes.

4. AI and Content Disclaimer

You acknowledge that:

• All conversations are AI-generated and may not always be accurate, appropriate, or reliable.
• Responses do not represent real human opinions or advice.
• Ni8.Life does not guarantee emotional, factual, or behavioral accuracy of any AI character.
• The Service is not a substitute for human relationships, therapy, or professional advice.
• You are solely responsible for how you interpret and use the AI's responses.

5. Payments and Billing

5.1 Payment Processing

• Payments are securely processed via Stripe.
• You authorize Ni8.Life to charge your selected payment method for call time, subscriptions, or credits.
• Pricing, call rates, and subscription tiers may change at our discretion with prior notice.

5.2 Refunds

• All purchases are final. Refunds are only issued in cases of proven technical failure directly caused by our system.
• Misuse, user error, or poor connection quality do not qualify for refunds.

5.3 Coupons & Promotions

Coupons, credits, or promotional offers may be subject to expiration, limits, and cancellation at our discretion.

6. Call Recording and Data Usage

6.1 Call Recording

By using the Platform, you consent to the collection, storage, and analysis of call transcripts, audio data, and logs for:

• Quality improvement
• Model fine-tuning
• Abuse prevention
• Analytics and billing

We will never sell or publicly share identifiable user data.

6.2 Privacy

7. Intellectual Property

All content, including AI character profiles, voice designs, audio outputs, software code, and branding, are the exclusive property of Ni8.Life Technologies Pvt. Ltd. (or its licensors). You may not copy, modify, distribute, or create derivative works without written permission.

User-generated content (e.g., conversations or voice inputs) remains your property, but by using the Services you grant us a worldwide, royalty-free license to use such data for improving AI quality and service performance.

8. Service Availability

• We strive for 24/7 uptime but do not guarantee uninterrupted access.
• Service interruptions may occur due to maintenance, system updates, third-party outages (e.g., Twilio, OpenAI, or Stripe), or force majeure events.
• We are not liable for any damages or losses arising from downtime or call interruptions.

9. Limitation of Liability

To the fullest extent permitted by law:

• Ni8.Life and its affiliates are not liable for any indirect, incidental, consequential, or emotional damages arising from use of the Service.
• You use the Service at your own risk.
• Our total liability shall not exceed the total amount paid by you in the 30 days preceding the claim.

You agree to indemnify and hold harmless Ni8.Life, its officers, employees, and affiliates from any claims, damages, or expenses resulting from:
